Article 2 the construction unit engaged in the construction, decoration and decoration of various housing buildings and their ancillary facilities within the territory of the people's Republic of China, as well as the installation of supporting lines, pipelines and equipment, as well as the construction of urban municipal infrastructure projects shall, in accordance with the provisions of these measures, Apply to the construction administrative department of the people's government at or above the county level (hereinafter referred to as the issuing authority) where the project is located for a construction license
construction projects with an investment of less than 300000 yuan or a construction area of less than 300 square meters may not apply for a construction permit. The construction administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government may adjust the quotas according to the actual local conditions and report them to the construction administrative department of the State Council for the record
construction projects that have approved the commencement report in accordance with the authority and procedures prescribed by the State Council will no longer receive a construction permit
Article 3 construction projects that must apply for construction licenses according to these Measures shall not start construction unless they have obtained construction licenses with stable performance
no unit or individual shall break down the project that should apply for a construction permit into several projects below the limit to avoid applying for a construction permit
Article 4 when applying for a construction permit, the construction unit shall meet the following conditions and submit the corresponding supporting documents:
(I) the land approval procedures for the construction project have been handled
(II) the construction project in the urban planning area has obtained the construction project planning license
(III) if the construction site has basically met the construction conditions and needs demolition, the demolition progress meets the construction requirements
(IV) the construction enterprise has been determined. According to the regulations, if there is no bidding for the project that should be invited for bidding, there is no public bidding for the project that should be invited for bidding, or the contracted project is dismembered, and the project is contracted to a construction enterprise that does not have the corresponding qualifications, the determined construction enterprise is invalid
(V) the construction drawings and technical data that have met the construction needs, and the construction drawing design documents have been reviewed as required
(VI) there are specific measures to ensure project quality and safety. The construction organization design prepared by the construction enterprise includes the corresponding quality and safety technical measures formulated according to the characteristics of the construction project, the special quality and safety construction organization design prepared for the highly professional project, and the engineering quality and safety supervision procedures have been handled in accordance with the regulations
(VII) the project that should be entrusted with supervision according to the regulations has been entrusted with supervision
(VIII) construction funds have been implemented. If the construction period is less than one year, the funds in place shall not be less than 50% of the project contract price in principle. At present, IKv is developing relevant processing technology. If the construction period is more than one year, the funds in place shall not be less than 30% of the project contract price in principle. The construction unit shall provide the certificate of funds in place issued by the bank, and may implement the bank payment guarantee or other third-party guarantee if conditions permit
(IX) other conditions stipulated by laws and administrative regulations
Article 5 the application for construction permit shall be carried out in accordance with the following procedures:
(I) the construction unit shall obtain the application form for construction permit from the issuing authority
(II) the construction unit shall hold the "application form for construction permit of Construction Engineering" with the end of the bolt slightly protruding from the nut stamped with the seal of the unit and the legal representative, and attach the supporting documents specified in Article 4 of these measures to apply to the issuing authority
(III) after receiving the application form for construction permit of construction engineering and the attached supporting documents submitted by the construction unit, the issuing authority shall issue the construction permit within 15 days from the date of receiving the application if the conditions are met; If the supporting documents are incomplete or invalid, the construction unit shall be required to make corrections within a time limit, and the approval time can be postponed accordingly after the supporting documents are completed; For those who do not meet the conditions, they shall notify the construction unit in writing within 15 days from the date of receiving the application, and explain the reasons
in the construction process of a construction project, if the construction unit or the construction unit changes, it shall re apply for a construction permit
Article 6 the name, location and scale of the project for which the construction unit applies for a construction permit shall be consistent with the construction contract signed according to lawthe construction permit shall be placed on the construction site for future reference
Article 7 the construction permit shall not be forged or altered
Article 8 the construction unit shall start construction within three months from the date of receiving the construction permit for holding a press conference on November 24 local time. If the construction cannot be started on schedule for some reason, it shall apply to the license issuing authority for extension before the expiration of the period, and explain the reasons; The extension shall be limited to two times, each time not exceeding three months. The construction permit shall be automatically abolished if it neither starts construction nor applies for extension or exceeds the extension times and time limit
Article 9 if the construction of a construction project under construction is suspended for some reason, the construction unit shall report to the license issuing authority within two months from the date of suspension of construction, including the time of suspension of construction, reasons, parts under construction, maintenance and management measures, etc., and do a good job in the maintenance and management of the construction project in accordance with the regulations
when a construction project resumes construction, it shall report to the issuing authority: before resuming construction of a project that has suspended construction for a full year, the construction unit shall report to the issuing authority for verification of the construction permit
Article 10 for those who do not obtain the construction permit or carry out construction without authorization after breaking down the project in order to avoid handling the construction permit, the issuing authority with jurisdiction shall order them to make corrections, and those who do not meet the conditions for commencement shall be ordered to stop construction, and the construction unit and the construction unit shall be fined respectively
Article 11 for those who cheat the construction permit by using false supporting documents, the original issuing authority shall withdraw the construction permit, order them to stop construction, and impose a fine on the unit; If a crime is constituted, the offender shall be investigated for criminal responsibility according to law
Article 12 If a construction permit is forged, the construction permit is invalid, and the issuing authority shall order it to stop the construction and impose a fine on the unit; If a crime is constituted, the offender shall be investigated for criminal responsibility according to law
